Keadilan Hukum Atas Pemberian Amnesti Dan Abolisi Terhadap Terpidana Korupsi Di Indonesia

Penelitian ini dilatarbelakangi oleh perdebatan mengenai keadilan hukum dalam pemberian amnesti dan abolisi terhadap terpidana korupsi di Indonesia. Korupsi sebagai kejahatan luar biasa berdampak pada stabilitas politik, ekonomi, serta pemenuhan hak asasi manusia, sehingga pengampunan bagi pelakunya dinilai bertentangan dengan prinsip persamaan di hadapan hukum dan rule of law. Tujuan penelitian ini adalah menganalisis kewenangan prerogatif Presiden dalam pemberian amnesti dan abolisi pada kasus korupsi serta menilai kesesuaiannya dengan konsep keadilan hukum. Dengan menggunakan metode yuridis normatif melalui kajian peraturan perundang-undangan dan literatur, penelitian menemukan bahwa pemberian amnesti atau abolisi bagi koruptor tidak memiliki legitimasi keadilan karena melemahkan kepastian hukum, menimbulkan impunitas, dan mengikis kepercayaan publik. Dari perspektif hukum internasional, korupsi termasuk pelanggaran hak ekonomi dan sosial sehingga pengampunan terhadap koruptor bertentangan dengan norma antimpunitas global. Karena itu, pemberian amnesti dan abolisi harus ditolak demi menjaga integritas hukum dan keadilan substantif.References
